Gala 2022 Waiver

The undersigned is an attendee (the “Attendee”) who wishes to participate in the 2022 Great Gatsby Gala and Auction (the “Auction”) to be held by Lake Tahoe School (the “School”) on May 21, 2022. In consideration for my participation in the Auction, I hereby agree to the terms and conditions below:

Voluntary Participation: I understand that my participation in the Auction is entirely voluntary and is not required for any other reason. I certify that I am in good physical condition and able to participate in the Auction at my own risk. I certify that there are no health-related reasons or problems, including a current COVID-19 infection, which precludes my participation in this activity.

Use of Images: I understand that I may be included in photographs, audio recordings and/or videos relating to my participation in the Auction (collectively, the “Images and Recordings”). I hereby give and grant in perpetuity to the School and its trustees, officers, employees, subsidiaries, affiliates, representatives, agents, successors and assigns, and any person, corporation, or entity acting under its permission or with its authority, or for whom it might be acting, including anyone distributing or disseminating communications by or regarding the School (hereinafter collectively referred to as the “Licensed Parties”) the irrevocable, unrestricted right, permission and license to publish, reproduce, distribute, broadcast, and/or otherwise use the Images and Recordings in any and all mediums, including for commercial use. I further understand that the School is and shall be the exclusive owner of all right, title and interest (including copyright) in and to the Images and Recordings. I hereby waive all rights of inspection or approval with regard to any use of the Images and Recordings, and hereby release, discharge, and hold harmless the School and its trustees, officers, employees, subsidiaries, affiliates, representatives, agents, successors and assigns, from any and all liability that may arise, directly or indirectly, now or in the future, by reason of any damage, loss, or expense incurred in connection with the use of the Images and Recordings.

Assumption of the Risk, Waiver and Release of Liability: I understand and agree that participation in any activity creates the risk of accident, injury, or illness. While some accidents, injuries, and illnesses, will be relatively minor, I am aware that there is also a risk that such accidents, injuries and illnesses could be severe. I further understand that while the School is exercising reasonable diligence to ensure the safety and wellbeing of all auction attendees during their participation, I understand that it is not possible to eliminate all potential risks. Among other things, I understand that my participation in the Auction during the COVID-19 pandemic creates the risk that I could be exposed to COVID-19. I further acknowledge that I am aware of the risks associated with COVID-19, including serious illness, medical complications, and death, and that certain vulnerable individuals may have greater health risks associated with exposure to COVID-19, including individuals with serious underlying health conditions whose immune systems are compromised. I hereby release and discharge all claims against the School, its Board of Directors, successors, assigns, officers, employees, volunteers, and agents and will hold them harmless from any and all liability or demands for personal injury, psychological injury, sickness, medical expenses, other losses, death, or claims resulting from personal injury or property damage, of any nature whatsoever which may be incurred by me relating to or as a result of my participation in the Auction. I agree that this release includes personal injury, illness, medical expenses, or other losses caused by or resulting from negligence, active or passive, of the School, its directors, employees and agents; however, the release does not apply to liability for gross negligence, willful injury, or fraud, and is not intended to release the School’s insurers, if any, or non-agent third parties of any responsibility for any claims that may otherwise be asserted.

I acknowledge and represent that I have read the Authorization and Release from Liability, fully understand it and agree to its provisions, and sign it voluntarily as my own free act. No oral representations, statements, or inducements apart from the foregoing Authorization and Release from Liability that has been reduced to writing have been made and no modifications or alternations may be made to this form.
